Note on data transfer to third countries that are not secure in terms of data protection law as well as transfer to US companies that are not DPF-certified

Among other things, we use tools from companies based in third countries that are not secure in terms of data protection law as well as US tools whose providers are not certified according to the EU-US Data Privacy Framework (DPF). If these tools are active, your personal data may be transferred to and processed in these countries. We would like to point out that in third countries that are insecure in terms of data protection law, it is not possible to guarantee a level of data protection comparable to that of the EU.

We would like to point out that the USA, as a safe third country, generally has a level of data protection comparable to that of the EU. The purpose of reCAPTCHA is to check whether the data entry on this website (e.g. in a contact form) is made by a human or by an automated program. 6. Telephone and/or video conferences

Zoom

We use the Zoom tool to conduct telephone conferences, online meetings and/or video conferences (hereinafter: "online meetings"). If we would like to record an "online meeting", we will inform you transparently in advance and - if necessary - ask for your consent. The fact of the recording is also displayed in the "Zoom" app.

The provider is Zoom Video Communications, Inc., which is based in the USA. Processing of personal data therefore also takes place in a third country.

Legal basis for data processing

The legal basis for data processing when conducting "online meetings" is Art. 6 para. 1 lit. b) GDPR, insofar as the meetings are conducted within the framework of contractual relationships. If there is no contractual relationship, the legal basis is Art. 6 para. 1 lit. f) GDPR. Here, too, we are interested in the effective implementationof "online meetings".

Object of data processing

The scope of the data that is collected also depends on the information you provide before or during participation in an "online meeting".

The following personal data are subject to processing:

User details: first name, last name, telephone (optional), e-mail address, password (if "single sign-on" is not used), profile picture (optional), department (optional)

Meeting metadata: topic, description (optional), participant IP addresses, device/hardwareinformation

For recordings (optional): MP4 file of all video, audio and presentation recordings, MP4 file of all audio recordings, text file of the online meeting chat.

When dialing in by telephone: information on the incoming and outgoing phone number, country name, start and end time.

If necessary, further connection data such as the IP address of the device can be stored.

Text, audio and video data: You may have the option of using the chat, question or survey functions in an "online meeting". In this respect, the text entries you make will be processed in order to display them in the "online meeting" and, if necessary, to log them. In order to enable the display of video and the playback of audio, the data from the microphone of your device and from any video camera of the device will be processed accordingly for the duration of the meeting. You can switch off or mute the camera or microphone yourself at any time via the "Zoom" applications.

In order to participate in an "online meeting" or to enter the "meeting room", you must at least provide information about your name.

Data protection at the provider

Zoom Video Communications, Inc. uses standard contractual clauses (copy  can be viewed here). Other certifications according to .dem Zoom Security Whitepaper: SOC2, TRUSTe and FedRAMP. An adequate level of data protection is thus given.

Data processing agreement

Since 07.04.2020, the order processing agreement with Zoom is automatically concluded when registering a Zoom account by automatically including all documents linked under Zoom Legal Compliance in the contractual relationship by accepting Zoom's terms of use.  This then also includes the Data Processing Agreement (DPA); in particular, the "Zoom Global Data Processing Addendum" is also expressly listed in No. 19 of Zoom's Terms of Use.

 

Making appointments via calendly
We use the calendly tool to make appointments simply, quickly and easily. We use calendly to improve our service for existing and new clients. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

When using the tool, you will be asked to provide personal data such as your name, email address and telephone number. You also have the option of presenting your request and providing us with further information. If you use the tool, your details from the inquiry form, including the information you provide there, will be stored and, of course, transmitted over the Internet. The data entered is processed exclusively on the basis of your consent (Art. 6 para. 1 lit. a GDPR).

7. Privacy policy for our social mediapresences

Data processing by social networks

We maintain publicly accessible profiles on social networks. The social networks we use in detail can be found below.

Social networks such as Facebook, Twitter, etc. can usually comprehensively analyze your user behavior when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). By visiting our social media presences, numerous data protection-relevant processing operations are triggered.

In detail:

If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, this data collection takes place, for example, via cookies that are stored on your device or by recording your IP address.

Legal basis

Our social media presences are intended to ensure the widest possible presence on the Internet. This is a legitimate interest within the meaning of Article 6 (1) (f) GDPR. The analysis processes initiated by the social networks may be based on different legal bases, which must be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6 para. 1 lit. a DSGVO).

Controller and assertion of rights

If you visit one of our social media sites (e.g. Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. In principle, you can assert your rights (information, correction, deletion, restriction of processing, data portability and complaint) both against us and against .dem operator of the respective social media portal (e.g. against Facebook).

Please note that despite the joint responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are largely based on the corporate policy oftherespectiveprovider.

Storage period

The data collected directly by us via the social media presence will be deleted from our systems as soon as the purpose for its storage no longer applies, you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory legal provisions – esp. Retention periods – remainunaffected.
